СПОСОБЫ ЛИМИТИРОВАНИЯ НАСЛЕДСТВА И ОТКАЗ ОТ НИХ В РОССИЙСКОМ И АМЕРИКАНСКОМ ПРАВЕ <*>
В статье проанализированы все три способа лимитирования наследства: запрет наследовать отдельным группам лиц, запрет наследовать имущество выше определенного предела и налогообложение наследства - и сделан вывод об их полном исчезновении в праве России и сохранении реликтов первого способа лимитирования и полностью последнего - прогрессивного налогообложения - в США.
The article contains the analysis of all three kinds of limitations in inheritance estates. These are prohibition of inheriting for some particular groups of people, the ban of inheriting above a monetary limit, and progressive taxation of estate or/and inheritance. The political and legal development of society resulted in full abolition of all kinds of limitations in Russian Law and preservation of the relics of the first kind of limitations and totally the second one in US Law.
